By accessing or using PatentCobot.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

PatentCobot provides an API service that processes and analyzes US patent data sourced from the United States Patent and Trademark Office (USPTO). Our service:

• Extracts structured data from US patents
• Analyzes patent claims and dependencies
• Provides Freedom to Operate (FTO) analysis
• Offers patent search and discovery capabilities

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your account credentials secure
• Be responsible for all activities under your account
• Notify us immediately of unauthorized access

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Reverse engineer or decompile the Service
• Use automated scripts to abuse the API
• Resell or redistribute the Service without permission
• Use the Service for illegal patent infringement

API usage is subject to rate limits and quotas based on your subscription plan:

• Startup Founder: 3 requests/month
• Professional: 100 requests/month
• Enterprise: Custom limits as agreed

Exceeding your plan limits may result in additional charges (overage pricing) or temporary service suspension.

Subscription Fees

Paid plans are billed monthly in advance. All fees are non-refundable unless required by applicable law.

Overage Charges

Usage exceeding your plan limits will be charged according to our overage pricing:

• Startup Founder: $2 per additional patent
• Professional: $1 per additional patent
• Enterprise: $0.50 per additional patent

Payment Methods

We accept major credit cards. You authorize us to charge your payment method for all applicable fees.

USPTO Data

Patent data processed through our Service is sourced from the USPTO and remains in the public domain. We do not claim ownership of patent content.

Our Intellectual Property

The Service, including our API, algorithms, and analysis capabilities, is our intellectual property and protected by copyright and other laws.

Your Data

You retain ownership of any data you submit to the Service. You grant us a license to process this data to provide the Service.

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability.

Support is provided based on your subscription plan:

• Startup Founder: Community support
• Professional: Email support
• Enterprise: Priority phone support

Service Disclaimer

The Service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

Legal Analysis Disclaimer

Important: Our Service provides technical analysis of patent data but does not constitute legal advice. Patent law is complex, and you should consult qualified legal counsel for legal matters related to patents.

Limitation of Liability

Our liability is limited to the amount paid for the Service in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

We comply with applicable data protection laws, including GDPR for EU users.

Either party may terminate this agreement at any time:

• You may cancel your account through the dashboard
• We may suspend or terminate accounts for violations
• We may discontinue the Service with 30 days' notice

Upon termination, your access to the Service will cease, and we may delete your account data after a reasonable period.

We may modify these Terms at any time. Material changes will be posted on our website and, for registered users, sent via email. Continued use of the Service after changes constitutes acceptance.

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except for claims of intellectual property infringement.
